5 Mose 21

1 »Wenn man in dem Lande, das der HERR, dein Gott, dir zum Eigentum gibt, einen Erschlagenen auf dem Felde liegend findet, von dem nicht bekannt ist, wer ihn erschlagen hat,

If one be founde slaine in the lande, which the Lord thy God giueth thee to possesse it, lying in the field, and it is not knowe who hath slaine him,

2 so sollen deine Ältesten und deine Richter hinausgehen und die Entfernungen bis zu den Ortschaften abmessen, die rings um den Erschlagenen liegen.

Then thine Elders and thy Iudges shall come forth, and measure vnto the cities that are round about him that is slayne.

3 Dann sollen die Ältesten derjenigen Ortschaft, die dem Erschlagenen am nächsten liegt, eine junge Kuh nehmen, die noch nicht zur Arbeit benutzt und noch nie ins Joch gespannt worden ist,

Aud let ye Elders of that citie, which is next vnto the slaine man, take out of the droue an heifer that hath not bene put to labour, nor hath drawen in the yoke.

4 und die Ältesten der betreffenden Ortschaft sollen die Kuh zu einem immerfließenden Bach hinführen, in dem nicht gearbeitet und an dem nicht gesät wird, und sollen der Kuh dort das Genick brechen, so daß das Blut in den Bach hineinfließt.

And let the Elders of that citie bring the heifer vnto a stonie valley, which is neyther eared nor sowen, and strike off the heifers necke there in the valley.

5 Hierauf sollen die Priester vom Stamm Levi herantreten; denn sie hat der HERR, dein Gott, erwählt, damit sie ihm dienen und im Namen des HERRN segnen, und nach ihrem Ausspruch soll bei jedem Rechtshandel und jedem Verbrechen verfahren werden.

Also the Priests the sonnes of Leui (whom the Lord thy God hath chosen to minister, and to blesse in the name of the Lord) shall come forth, and by their word shall all strife and plague be tried.

6 Dann sollen alle Ältesten der betreffenden Ortschaft, weil sie dem Erschlagenen am nächsten wohnen, über der Kuh, der man das Genick in den Bach hinein gebrochen hat, ihre Hände waschen

And all the Elders of that citie that came neere to the slayne man, shall wash their hands ouer the heifer that is beheaded in the valley:

7 und mit erhobener Stimme aussagen: ›Unsere Hände haben dieses Blut nicht vergossen, und unsere Augen haben nichts von der Tat gesehen!

And shall testifie, and say, Our handes haue not shed this blood, neither haue our eies seene it.

8 Vergib, o HERR, deinem Volke Israel, das du erlöst hast, und mache dein Volk Israel nicht für unschuldig in seiner Mitte vergossenes Blut verantwortlich!‹ Dann wird die Blutschuld für sie gesühnt sein!

O Lord, be mercifull vnto thy people Israel, whom thou hast redeemed, and lay no innocent blood to the charge of thy people Israel, and the blood shalbe forgiuen them.

9 So sollst du das unschuldig vergossene Blut aus deiner Mitte wegschaffen, indem du das tust, was in den Augen des HERRN das Richtige ist.«

So shalt thou take away the cry of innocet blood from thee, when thou shalt do that which is right in the sight of the Lord.

10 »Wenn du zum Kriege gegen deine Feinde ausziehst und der HERR, dein Gott, sie in deine Gewalt gibt und du Gefangene von ihnen erbeutest

Whe thou shalt go to warre against thine enemies, and the Lord thy God shall deliuer them into thine hands, and thou shalt take the captiues,

11 und du unter den Gefangenen ein Weib von schöner Gestalt siehst und sie liebgewinnst, so daß du sie zur Frau nehmen möchtest,

And shalt see among the captiues a beautifull woman, and hast a desire vnto her, and wouldest take her to thy wife,

12 so sollst du sie in dein Haus hineinführen; sie schere sich dann das Haupt, beschneide ihre Nägel,

Then thou shalt bring her home to thine house, and she shall shaue her head, and pare her nayles,

13 lege die Kleidung ab, die sie als Gefangene getragen hat, bleibe in deinem Hause und betrauere ihre Eltern einen Monat lang; danach darfst du zu ihr eingehen und die Ehe mit ihr vollziehen, und sie darf als deine Frau gelten.

And she shall put off the garment that shee was taken in, and she shall remaine in thine house, and bewaile her father and her mother a moneth long: and after that shalt thou go in vnto her, and marry her, and she shalbe thy wife.

14 Wenn du dich aber nicht mehr zu ihr hingezogen fühlst, so hast du sie gehen zu lassen, wohin es ihr beliebt; aber für Geld darfst du sie keinesfalls verkaufen, darfst sie auch nicht gewalttätig (als Sklavin) behandeln, weil du ehelich mit ihr gelebt hast.«

And if thou haue no fauour vnto her, then thou mayest let her go whither she will, but thou shalt not sell her for money, nor make marchandise of her, because thou hast humbled her.

15 »Wenn ein Mann zwei Frauen hat, von denen ihm die eine lieb, die andere ungeliebt ist, und sie beide ihm Söhne gebären, die geliebte wie die ungeliebte, und der erstgeborene Sohn von der ungeliebten Frau stammt,

If a man haue two wiues, one loued and another hated, and they haue borne him children, both the loued and also the hated: if the first borne be the sonne of the hated,

16 so darf er an dem Tage, an welchem er sein Vermögen an seine Söhne als Erbgut verteilt, nicht dem Sohne der geliebten Frau die Rechte der Erstgeburt verleihen zum Schaden des Sohnes der ungeliebten, welcher doch tatsächlich der Erstgeborene ist;

Then when the time commeth, that hee appointeth his sonnes to be heires of that which he hath, he may not make the sonne of the beloued first borne before the sonne of the hated, which is the first borne:

17 sondern er muß den Erstgeborenen, den Sohn der ungeliebten Frau, als solchen anerkennen, indem er ihm zwei Teile von seinem gesamten Vermögen überweist; denn dieser ist der Erstling seiner Kraft: ihm steht das Erstgeburtsrecht zu.«

But he shall acknowledge the sonne of the hated for the first borne, and giue him double portion of all that he hath: for hee is the first of his strength, and to him belongeth the right of the first borne.

18 »Wenn jemand einen störrischen und widerspenstigen Sohn hat, der auf die Mahnungen seines Vaters und seiner Mutter nicht hört und ihnen trotz aller Zurechtweisungen nicht gehorcht,

If any man haue a sonne that is stubburne and disobedient, which wil not hearken vnto the voice of his father, nor the voyce of his mother, and they haue chastened him, and he would not obey them,

19 so sollen seine Eltern ihn ergreifen und ihn vor die Ältesten der betreffenden Ortschaft und zwar an das Tor des betreffenden Ortes führen

Then shall his father and his mother take him, and bring him out vnto the Elders of his citie, and vnto the gate of the place where he dwelleth,

20 und sollen zu den Ältesten der Ortschaft sagen: ›Dieser unser Sohn ist störrisch und widerspenstig; er hört nicht auf unsere Mahnungen, ist ein Verschwender und Trinker!‹

And shall say vnto the Elders of his citie, This our sonne is stubburne and disobedient, and he wil not obey our admonition: he is a riotour, and a drunkard.

21 Dann sollen alle Männer der betreffenden Ortschaft ihn zu Tode steinigen. So sollst du das Böse aus deiner Mitte wegschaffen, und alle Israeliten sollen es erfahren und es sich zur Warnung dienen lassen.«

Then all the men of his citie shall stone him with stones vnto death: so thou shalt take away euill from among you, that all Israel may heare it, and feare.

22 »Wenn jemand ein todeswürdiges Verbrechen begangen hat und man ihn nach seiner Tötung an einen Baum hängt,

If a man also haue committed a trespasse worthy of death, and is put to death, and thou hangest him on a tree,

23 so soll sein Leichnam nicht über Nacht an dem Baume hängen bleiben, sondern du sollst ihn unbedingt noch an demselben Tage begraben; denn ein Gehenkter ist von Gott verflucht, und du darfst dein Land, das der HERR, dein Gott, dir zum Eigentum geben will, nicht verunreinigen.«

His body shall not remaine all night vpon the tree, but thou shalt bury him the same day: for the curse of God is on him that is hanged. Defile not therfore thy land which the Lord thy God giueth thee to inherite.
