出エジプト記 21
1 是は汝が民の前に立べき律例なり
Now these [are] the judgments which thou shalt set before them.
2 汝ヘブルの僕を買ふ時は六年の間之に職業を爲しめ第七年には贖を索ずしてこれを釋つべし
If thou shalt buy a Hebrew servant, six years he shall serve: and in the seventh he shall depart free for nothing.
3 彼もし獨身にて來らば獨身にて去べし若妻あらばその妻これとともに去べし
If he came in by himself, he shall depart by himself: if he was married, then his wife shall depart with him.
4 もしその主人これに妻をあたへて男子又は女子これに生れたらば妻とその子等は主人に屬すべし彼は獨身にて去べし
If his master hath given him a wife, and she hath borne him sons or daughters; the wife and her children shall be her master's, and he shall depart by himself.
5 僕もし我わが主人と我が妻子を愛す我釋たるるを好まずと明白に言ば
And if the servant shall plainly say, I love my master, my wife, and my children; I will not depart free:
6 その主人これを士師の所に携ゆき又戸あるひは戸柱の所につれゆくべし而して主人錐をもてかれの耳を刺とほすべし彼は何時までもこれに事ふべきなり
Then his master shall bring him to the judges; he shall also bring him to the door, or to the door-post: and his master shall bore his ear through with an awl; and he shall serve him for ever.
7 人若その娘を賣て婢となす時は僕のごとくに去べからす
And if a man shall sell his daughter to be a maid-servant, she shall not depart as the men-servants do.
8 彼もしその約せし主人の心に適ざる時はその主人これを贖はしむることを得べし然ど之に眞實ならずして亦これを異邦人に賣ことをなすを得べからず
If she shall not please her master, who hath betrothed her to himself, then shall he let her be redeemed: to sell her to a strange nation he shall have no power, seeing he hath dealt deceitfully with her.
9 又もし之を己の子に與へんと約しなばこれを女子のごとくに待ふべし
And if he hath betrothed her to his son, he shall deal with her after the manner of daughters.
10 父もしその子のために別に娶ることあるとも彼に食物と衣服を與ふる事とその交接の道とはこれを間斷しむべからず
If he shall take him another [wife]; her food, her raiment, and her duty of marriage shall he not diminish.
11 其人かれに此三を行はずば彼は金をつくのはずして出さることを得べし
And if he shall not perform these three to her, then shall she depart free without money.
12 人を撃て死しめたる妻は必ず殺さるべし
He that smiteth a man, so that he dieth, shall be surely put to death.
13 若人みづから畫策ことなきに神人をその手にかからしめたまふことある時は我汝のために一箇の處を設くればその人其處に逃るべし
And if a man shall not lie in wait, but God shall deliver [him] into his hand; then I will appoint thee a place whither he shall flee.
14 人もし故にその隣人を謀りて殺す時は汝これをわが壇よりも執へゆきて殺すべし
But if a man shall come presumptuously upon his neighbor, to slay him with guile; thou shalt take him from my altar, that he may die.
15 その父あるひは母を撃ものは必ず殺さるべし
And he that smiteth his father, or his mother, shall be surely put to death.
16 人を拐帶したる者は之を賣たるも尚その手にあるも必ず殺さるべし
And he that stealeth a man, and selleth him, or if he shall be found in his hand, he shall surely be put to death.
17 その父あるひは母を罵る者は殺さるべし
And he that curseth his father, or his mother, shall surely be put to death.
18 人相爭ふ時に一人石または拳をもてその對手を撃ちしに死にいたらずして床につくことあらんに
And if men contend together, and one shall smite another with a stone, or with [his] fist, and he shall not die, but keep [his] bed:
19 若起あがりて杖によりて歩むにいたらば之を撃たる者は赦さるべし但しその業を休める賠償をなして之を全く愈しむべきなり
If he shall rise again, and walk abroad upon his staff, then shall he that smote [him] be quit: only he shall pay [for] the loss of his time, and shall cause [him] to be thoroughly healed.
20 人もし杖をもてその僕あるひは婢を撃んにその手の下に死ば必ず罰せらるべし
And if a man shall smite his servant, or his maid, with a rod, and he shall die under his hand; he shall be surely punished.
21 然ど彼もし一日二日生のびなば其人は罰せられざるべし彼はその人の金子なればなり
Notwithstanding, if he shall continue a day or two, he shall not be punished; for he [is] his money.
22 人もし相爭ひて妊める婦を撃ちその子を堕させんに別に害なき時は必ずその婦人の夫の要むる所にしたがひて刑られ法官の定むる所を爲べし
If men shall contend, and hurt a woman with child, so that her fruit shall depart [from her], and yet no mischief follow: he shall be surely punished, according as the woman's husband will lay upon him; and he shall pay as the judges [determine].
23 若害ある時は生命にて生命を償ひ
And if [any] mischief shall follow, then thou shalt give life for life,
24 目にて目を償ひ歯にて歯を償ひ手にて手を償ひ足にて足を償ひ
Eye for eye, tooth for tooth, hand for hand, foot for foot,
25 烙にて烙を償ひ傷にて傷を償ひ打傷にて打傷を償ふべし
Burning for burning, wound for wound, stripe for stripe.
26 人もしその僕の一の目あるひは婢の一の目を撃てこれを喪さばその目のために之を釋つべし
And if a man shall smite the eye of his servant, or the eye of his maid, that it shall perish; he shall let him go free for his eye's sake.
27 又もしその僕の一箇の歯か婢の一箇の歯を打落ばその歯のために之を釋つべし
And if he shall smite out his man-servant's tooth, or his maid-servant's tooth; he shall let him go free for his tooth's sake.
28 牛もし男あるひは女を衝て死しめなばその牛をば必ず石にて撃殺すべしその肉は食べからず但しその牛の主は罪なし
If an ox shall gore a man or a woman, that they die: then the ox shall be surely stoned, and his flesh shall not be eaten; but the owner of the ox [shall be] quit.
29 然ど牛もし素より衝くことをなす者にしてその主これがために忠告をうけし事あるに之を守りおかずして遂に男あるひは女を殺すに至らしめなばその牛は石にて撃れその主もまた殺さるべし
But if the ox was accustomed to push with his horn in time past, and it hath been testified to his owner, and he hath not restrained him, but that he hath killed a man or a woman; the ox shall be stoned, and his owner also shall be put to death.
30 若彼贖罪金を命ぜられなば凡てその命ぜられし者を生命の償に出すべし
If there shall be laid on him a sum of money, then he shall give for the ransom of his life whatever is laid upon him.
31 男子を衝も女子を衝もこの例にしたがひてなすべし
Whether he hath gored a son, or hath gored a daughter, according to this judgment shall it be done to him.
32 牛もし僕あるひは婢を衝ばその主人に銀三十シケルを與ふべし又その牛は石にて撃ころすべし
If the ox shall push a man-servant, or maid-servant; he shall give to their master thirty shekels of silver, and the ox shall be stoned.
33 人もし坑を啓くか又は人もし穴を掘ことをなしこれを覆はずして牛あるひは驢馬これに陷ば
And if a man shall open a pit, or if a man shall dig a pit, and not cover it, and an ox or an ass shall fall into it;
34 穴の主これを償ひ金をその所有主に與ふべし但しその死たる畜は己の有となるべし
The owner of the pit shall make compensation, [and] give money to the owner of them; and the dead [beast] shall be his.
35 此人の牛もし彼人のを衝殺さば二人その生る牛を賣てその價を分つべし又その死たるものをも分つべし
And if one man's ox shall hurt another's that he shall die, then they shall sell the live ox, and divide the money of it, and the dead [ox] also they shall divide.
36 然どその牛素より衝ことをなす者なること知をるにその主これを守りおかざりしならばその人かならず牛をもて牛を償ふべし但しその死たる者は己の有となるべし
Or if it shall be known that the ox hath used to push in time past, and his owner hath not restrained him; he shall surely pay ox for ox, and the dead shall be his own.
