< Exodus 21 >

1 And these [are] the judgments which you set before them:
“Hizi ndizo sheria utakazoweka mbele ya Waisraeli:
2 When you buy a Hebrew servant, he serves [for] six years, and in the seventh he goes out as a freeman for nothing;
“Kama ukimnunua mtumwa wa Kiebrania, atakutumikia kwa miaka sita. Lakini katika mwaka wa saba, atakuwa huru naye atakwenda zake pasipo kulipa chochote.
3 if he comes in by himself, he goes out by himself; if he [is] owner of a wife, then his wife has gone out with him;
Kama akija peke yake, atakwenda huru peke yake, lakini kama akija na mke, ataondoka pamoja naye.
4 if his lord gives a wife to him, and she has borne sons or daughters to him—the wife and her children are her lord’s, and he goes out by himself.
Kama bwana wake alimpatia mke naye akamzalia wana au binti, mwanamke pamoja na watoto wake watakuwa mali ya bwana wake na huyo mwanaume ataondoka peke yake.
5 And if the servant really says: I have loved my lord, my wife, and my sons—I do not go out free,
“Lakini kama mtumishi akisema, ‘Ninampenda bwana wangu, mke wangu pamoja na watoto na sitaki kuwa huru,’
6 then his lord has brought him near to God, and has brought him near to the door, or to the doorpost, and his lord has bored his ear with an awl, and he has served him for all time.
ndipo bwana wake atakapolazimika kumpeleka mbele ya waamuzi. Kisha atampeleka kwenye mlango au kizingiti na kutoboa sikio lake kwa shazia. Naye atamtumikia bwana wake maisha yake yote.
7 And when a man sells his daughter for a handmaid, she does not go out according to the going out of the menservants;
“Kama mtu akimuuza binti yake kuwa mtumwa, hataachwa huru kama watumwa wa kiume waachiwavyo.
8 if [it is] evil in the eyes of her lord, so that he has not betrothed her, then he has let her be ransomed; he has no power to sell her to a strange people, in his dealing treacherously with her.
Kama hakumpendeza bwana wake aliyemchagua, huyo bwana atamwacha akombolewe. Hatakuwa na haki ya kumuuza kwa wageni, kwa sababu huyo bwana atakuwa amekosa uaminifu.
9 And if he betroths her to his son, he does to her according to the right of daughters.
Kama akimchagua aolewe na mwanawe, ni lazima ampe haki za kuwa binti yake.
10 If he takes another [woman] for him, he does not withdraw her food, her covering, and her habitation;
Ikiwa huyo mwana aliyeozwa mtumwa mwanamke ataoa mwanamke mwingine, ni lazima aendelee kumtosheleza huyo mke wa kwanza kwa chakula, mavazi na haki zote za ndoa.
11 and if he does not do these three for her, then she has gone out for nothing, without money.
Iwapo hatamtosheleza kwa mambo hayo matatu, huyo mke wa kwanza ataondoka na kuwa huru bila malipo yoyote ya fedha.
12 He who strikes a man so that he has died is certainly put to death;
“Yeyote ampigaye mtu na kumuua ni lazima auawe hakika.
13 as for him who has not laid wait, but God has brought [him] to his hand, I have even set a place for you to where he flees.
Hata hivyo, kama hakumuua kwa makusudi, lakini Mungu akaruhusu itendeke, basi atakimbilia mahali nitakapomchagulia.
14 And when a man presumes against his neighbor to slay him with subtlety, you take him from My altar to die.
Lakini kama mtu akipanga na kumuua mwingine kwa makusudi, mwondoe katika madhabahu yangu na kumuua.
15 And he who strikes his father or his mother is certainly put to death.
“Yeyote amshambuliaye baba yake au mama yake ni lazima auawe.
16 And he who steals a man, and has sold him, and he has been found in his hand, is certainly put to death.
“Yeyote amtekaye nyara mwingine akamuuza au akamweka kwake, akikamatwa ni lazima auawe.
17 And he who is reviling his father or his mother is certainly put to death.
“Yeyote atakayemlaani baba yake au mama yake ni lazima auawe.
18 And when men contend, and a man has struck his neighbor with a stone, or with the fist, and he does not die, but has fallen on the bed;
“Kama watu wakigombana na mmoja akimpiga mwingine kwa jiwe au kwa ngumi yake na hakufa bali akaugua na kulala kitandani,
19 if he rises, and has gone up and down outside on his staff, then the striker has been acquitted; he only gives [for] his cessation, and he is thoroughly healed.
yule aliyempiga ngumi hatahesabiwa kuwa na hatia kama mwenzake ataamka na kujikongoja kwa fimbo yake, lakini hata hivyo, ni lazima amlipe fidia ya muda wake aliopoteza na awajibike mpaka apone kabisa.
20 And when a man strikes his manservant or his handmaid with a rod, and he has died under his hand—he is certainly avenged;
“Kama mtu akimpiga mtumwa wake wa kiume au wa kike kwa fimbo na mtumwa huyo akafa papo hapo, ni lazima aadhibiwe
21 only if he remains a day, or two days, he is not avenged, for he [is] his money.
lakini ikiwa mtumwa ataamka baada ya siku moja au mbili, hataadhibiwa, kwa sababu yule mtumwa ni mali yake.
22 And when men strive, and have struck a pregnant woman, and her children have come out, and there is no harm [to them], he is certainly fined as the husband of the woman lays on him, and he has given through the judges;
“Ikiwa watu wawili wanapigana na wakamuumiza mwanamke mjamzito, naye akazaa kabla ya wakati lakini hakuna majeraha makubwa, mhalifu atatozwa mali kiasi cha madai ya mume wa yule mwanamke, na jinsi mahakama itakavyoamua.
23 and if there is harm [to them], then you have given life for life,
Lakini kukiwa na jeraha kubwa, ni lazima ulipe uhai kwa uhai,
24 eye for eye, tooth for tooth, hand for hand, foot for foot,
jicho kwa jicho, jino kwa jino, mkono kwa mkono, mguu kwa mguu,
25 burning for burning, wound for wound, stripe for stripe.
kuchomwa moto kwa kuchomwa moto, jeraha kwa jeraha, mchubuko kwa mchubuko.
26 And when a man strikes the eye of his manservant, or the eye of his handmaid, and has destroyed it, he sends him away as a freeman for his eye;
“Ikiwa mtu atampiga mtumwa mwanaume au mwanamke kwenye jicho na kuliharibu, ni lazima amwache huru yule mtumwa kama fidia ya hilo jicho.
27 and if he knocks out a tooth of his manservant or a tooth of his handmaid, he sends him away as a freeman for his tooth.
Kama akimvunja jino mtumwa wa kiume au wa kike, ni lazima amwache huru huyo mtumwa kwa kufidia hilo jino.
28 And when an ox gores man or woman, and they have died, the ox is certainly stoned, and his flesh is not eaten, and the owner of the ox [is] acquitted;
“Kama fahali akimuua mwanaume au mwanamke kwa kumpiga kwa pembe, fahali huyo ni lazima auawe kwa kupigwa mawe, na nyama yake haitaliwa. Lakini mwenye fahali huyo hatawajibika.
29 and if the ox is [one] accustomed to gore before, and it has been testified to its owner, and he does not watch it, and it has put to death a man or woman, the ox is stoned, and its owner is also put to death.
Lakini hata hivyo, ikiwa huyo fahali amekuwa na tabia ya kupiga kwa pembe, na mwenyewe ameonywa na hakutaka kumfungia naye akamuua mwanaume au mwanamke, huyo fahali ni lazima auawe kwa mawe na mwenye fahali pia auawe.
30 If atonement is laid on him, then he has given the ransom of his life, according to all that is laid on him;
Lakini ikiwa malipo yatatakiwa kwake, basi anaweza kulipa kinachodaiwa ili kuukomboa uhai wake.
31 whether it gores a son or gores a daughter, according to this judgment it is done to him.
Sheria hii pia itatumika ikiwa fahali atampiga kwa pembe mwana au binti.
32 If the ox gores a manservant or a handmaid, he gives thirty silver shekels to their lord, and the ox is stoned.
Ikiwa fahali atampiga mtumwa wa kike au wa kiume, mwenye fahali atalipa shekeli thelathini za fedha kwa bwana mwenye mtumwa, na fahali ni lazima auawe kwa mawe.
33 And when a man opens a pit, or when a man digs a pit, and does not cover it, and an ox or donkey has fallen [in] there—
“Kama mtu akiacha shimo wazi, ama akachimba shimo kisha asilifukie, na ngʼombe au punda akatumbukia ndani yake,
34 the owner of the pit repays, he gives back money to its owner, and the dead is his.
mwenye shimo ni lazima alipe hasara iliyotokea; ni lazima amlipe mwenye mnyama. Mnyama aliyekufa atakuwa wake.
35 And when a man’s ox strikes the ox of his neighbor and it has died, then they have sold the living ox, and halved its money, and they also halve the dead one;
“Kama fahali wa mtu fulani atamuumiza fahali wa mtu mwingine na akafa, watamuuza yule aliye hai na wagawane sawa fedha pamoja na mnyama aliyekufa.
36 or, [if] it has been known that the ox is [one] accustomed to gore before, and its owner does not watch it, he certainly repays ox for ox, and the dead is his.
Hata hivyo, kama ikifahamika kwamba fahali huyo alikuwa na tabia ya kupiga kwa pembe na mwenyewe hakumfunga, ni lazima mwenye fahali alipe mnyama kwa mnyama, na mnyama aliyekufa atakuwa wake.
