< Exodus 21 >
1 And these [are] the judgments which you set before them:
Voici les ordonnances que tu leur proposeras.
2 When you buy a Hebrew servant, he serves [for] six years, and in the seventh he goes out as a freeman for nothing;
Si tu achètes un esclave hébreu, il te servira pendant six années; à la septième, il sortira libre sans rien donner.
3 if he comes in by himself, he goes out by himself; if he [is] owner of a wife, then his wife has gone out with him;
Qu’il s’en aille avec le même vêtement avec lequel il est entré; s’il a une femme, sa femme sortira aussi avec lui.
4 if his lord gives a wife to him, and she has borne sons or daughters to him—the wife and her children are her lord’s, and he goes out by himself.
Mais si c’est son maître qui lui a donné une femme, et qu’elle ait enfanté des fils et des filles, la femme et ses enfants seront à son maître; pour lui, il s’en ira avec son vêtement.
5 And if the servant really says: I have loved my lord, my wife, and my sons—I do not go out free,
Que si l’esclave dit: J’aime mon maître, et ma femme et mes enfants, je ne sortirai point pour être libre:
6 then his lord has brought him near to God, and has brought him near to the door, or to the doorpost, and his lord has bored his ear with an awl, and he has served him for all time.
Son maître le présentera aux dieux, puis il le fera approcher de la porte et des poteaux, percera son oreille d’une alène; et il sera son esclave pour toujours.
7 And when a man sells his daughter for a handmaid, she does not go out according to the going out of the menservants;
Si quelqu’un vend sa fille pour être servante, elle ne sortira pas comme les esclaves ont coutume de sortir.
8 if [it is] evil in the eyes of her lord, so that he has not betrothed her, then he has let her be ransomed; he has no power to sell her to a strange people, in his dealing treacherously with her.
Si elle déplaît aux yeux de son maître auquel elle avait été livrée, il la laissera aller; mais il n’aura pas le pouvoir de la vendre à un peuple étranger, s’il l’a méprisée.
9 And if he betroths her to his son, he does to her according to the right of daughters.
Mais s’il l’a fiancée à son fils, il la traitera à la manière des filles libres.
10 If he takes another [woman] for him, he does not withdraw her food, her covering, and her habitation;
Que s’il en prend une autre pour son fils, il procurera à la jeune fille un autre mariage, et il ne lui refusera pas ses vêtements et le prix de sa virginité.
11 and if he does not do these three for her, then she has gone out for nothing, without money.
S’il ne fait pas ces trois choses, elle sortira sans donner aucun argent.
12 He who strikes a man so that he has died is certainly put to death;
Que celui qui frappe un homme, voulant le tuer, meure de mort.
13 as for him who has not laid wait, but God has brought [him] to his hand, I have even set a place for you to where he flees.
Quant à celui qui n’a pas dressé d’embûches, mais aux mains duquel Dieu l’a livré, je te fixerai un lieu dans lequel il devra se réfugier.
14 And when a man presumes against his neighbor to slay him with subtlety, you take him from My altar to die.
Si quelqu’un tue son prochain de dessein prémédité et par surprise, tu l’arracheras de mon autel pour qu’il meure.
15 And he who strikes his father or his mother is certainly put to death.
Que celui qui frappe son père ou sa mère, meure de mort.
16 And he who steals a man, and has sold him, and he has been found in his hand, is certainly put to death.
Que celui qui vole un homme et le vend, convaincu de ce crime, meure de mort.
17 And he who is reviling his father or his mother is certainly put to death.
Que celui qui maudit son père ou sa mère, meure de mort.
18 And when men contend, and a man has struck his neighbor with a stone, or with the fist, and he does not die, but has fallen on the bed;
Si des hommes se querellent et que l’un frappe son prochain avec une pierre ou avec le poing, et que celui-ci ne meure point, mais qu’il gise dans un lit;
19 if he rises, and has gone up and down outside on his staff, then the striker has been acquitted; he only gives [for] his cessation, and he is thoroughly healed.
S’il se lève ensuite et qu’il marche dehors avec son bâton, celui qui l’a frappé sera innocent, de telle sorte cependant qu’il compense son travail interrompu et les dépenses des médecins.
20 And when a man strikes his manservant or his handmaid with a rod, and he has died under his hand—he is certainly avenged;
Celui qui frappe son esclave ou sa servante avec la verge, et qu’ils meurent entre ses mains, sera coupable de crime.
21 only if he remains a day, or two days, he is not avenged, for he [is] his money.
Mais s’ils survivent un jour ou deux, il ne sera pas soumis à la peine, parce que c’est son argent.
22 And when men strive, and have struck a pregnant woman, and her children have come out, and there is no harm [to them], he is certainly fined as the husband of the woman lays on him, and he has given through the judges;
Si des hommes se querellent, et que l’un frappe une femme enceinte, et qu’elle accouche à la vérité d’un enfant mort, mais quelle vive elle-même, il sera soumis à une amende telle que le mari de la femme la demandera et que des arbitres l’assigneront.
23 and if there is harm [to them], then you have given life for life,
Mais si la mort de la femme s’ensuit, il rendra âme pour âme,
24 eye for eye, tooth for tooth, hand for hand, foot for foot,
(Oeil pour œil, dent pour dent, main pour main, pied pour pied,
25 burning for burning, wound for wound, stripe for stripe.
Brûlure pour brûlure, plaie pour plaie, meurtrissure pour meurtrissure.
26 And when a man strikes the eye of his manservant, or the eye of his handmaid, and has destroyed it, he sends him away as a freeman for his eye;
Si quelqu’un frappe l’œil de son esclave ou de sa servante, et qu’il les rende borgnes, il les laissera aller libres pour l’œil qu’il a enlevé.
27 and if he knocks out a tooth of his manservant or a tooth of his handmaid, he sends him away as a freeman for his tooth.
De même, s’il fait tomber la dent de son esclave ou de sa servante, il les laissera pareillement aller libres.
28 And when an ox gores man or woman, and they have died, the ox is certainly stoned, and his flesh is not eaten, and the owner of the ox [is] acquitted;
Si un bœuf frappe de la corne un homme et une femme, et qu’ils meurent, il sera lapidé, et l’on ne mangera point de sa chair, mais le maître du bœuf sera innocent.
29 and if the ox is [one] accustomed to gore before, and it has been testified to its owner, and he does not watch it, and it has put to death a man or woman, the ox is stoned, and its owner is also put to death.
Que si un bœuf frappait de la corne depuis hier et avant-hier, et qu’on ait averti son maître, et qu’il ne l’ait pas enfermé, qu’ensuite le bœuf ait tué un homme ou une femme, et le bœuf sera lapidé, et on fera mourir son maître.
30 If atonement is laid on him, then he has given the ransom of his life, according to all that is laid on him;
Que si une amende lui est imposée, il donnera pour son âme tout ce qui sera demandé.
31 whether it gores a son or gores a daughter, according to this judgment it is done to him.
S’il frappe aussi de la corne un garçon ou une fille, le maître sera soumis au même jugement.
32 If the ox gores a manservant or a handmaid, he gives thirty silver shekels to their lord, and the ox is stoned.
S’il se jette sur un esclave ou sur une servante, il donnera trente sicles d’argent au maître, mais le bœuf sera lapidé.
33 And when a man opens a pit, or when a man digs a pit, and does not cover it, and an ox or donkey has fallen [in] there—
Si quelqu’un ouvre une citerne et la creuse, et ne la couvre pas, et qu’il y tombe un bœuf ou un âne,
34 the owner of the pit repays, he gives back money to its owner, and the dead is his.
Le maître de la citerne rendra le prix des bêtes; mais ce qui aura péri sera à lui.
35 And when a man’s ox strikes the ox of his neighbor and it has died, then they have sold the living ox, and halved its money, and they also halve the dead one;
Si le bœuf de quelqu’un blesse le bœuf d’un autre, et que ce bœuf meure, ils vendront le bœuf vivant, et ils partageront le prix, mais le corps du mort, ils le diviseront entre eux.
36 or, [if] it has been known that the ox is [one] accustomed to gore before, and its owner does not watch it, he certainly repays ox for ox, and the dead is his.
Mais si le maître savait que le bœuf frappait de la corne depuis hier et avant-hier, et qu’il ne l’ait point gardé, il rendra bœuf pour bœuf, mais il prendra le corps mort tout entier.
