< Exodus 21 >
1 And these [are] the judgments which you set before them:
Et voici les statuts que tu leur exposeras.
2 When you buy a Hebrew servant, he serves [for] six years, and in the seventh he goes out as a freeman for nothing;
Si tu achètes un esclave hébreu, il restera six années esclave et à la septième il sera remis en liberté sans rançon.
3 if he comes in by himself, he goes out by himself; if he [is] owner of a wife, then his wife has gone out with him;
S’Il est venu seul, seul il sortira; s’il était marié, sa femme sortira avec lui.
4 if his lord gives a wife to him, and she has borne sons or daughters to him—the wife and her children are her lord’s, and he goes out by himself.
Si son maître lui a donné une femme, laquelle lui ait enfanté des fils ou des filles, la femme, avec les enfants, appartiendra à son maître et lui se retirera seul.
5 And if the servant really says: I have loved my lord, my wife, and my sons—I do not go out free,
Que si l’esclave dit: "J’Aime mon maître, ma femme et mes enfants, je ne veux pas être affranchi",
6 then his lord has brought him near to God, and has brought him near to the door, or to the doorpost, and his lord has bored his ear with an awl, and he has served him for all time.
son maître l’amènera par-devant le tribunal, on le placera près d’une porte ou d’un poteau; et son maître lui percera l’oreille avec un poinçon et il le servira indéfiniment.
7 And when a man sells his daughter for a handmaid, she does not go out according to the going out of the menservants;
"Si un homme vend sa fille comme esclave, elle ne quittera pas son maître à la façon des esclaves.
8 if [it is] evil in the eyes of her lord, so that he has not betrothed her, then he has let her be ransomed; he has no power to sell her to a strange people, in his dealing treacherously with her.
Si elle lui déplaît et qu’il ne la réserve point à lui-même, il la laissera s’affranchir; il n’aura pas pouvoir de la vendre à une famille étrangère, après l’avoir déçue.
9 And if he betroths her to his son, he does to her according to the right of daughters.
Que s’il la fiance à son fils, il procédera à son égard selon. la règle des filles.
10 If he takes another [woman] for him, he does not withdraw her food, her covering, and her habitation;
S’Il lui en adjoint une autre, il ne devra point la frustrer de sa nourriture, de son habillement, ni du droit conjugal.
11 and if he does not do these three for her, then she has gone out for nothing, without money.
Et s’il ne procède pas à son égard de l’une de ces trois manières, elle se retirera gratuitement, sans rançon.
12 He who strikes a man so that he has died is certainly put to death;
"Celui qui frappe un homme et le fait mourir sera puni de mort.
13 as for him who has not laid wait, but God has brought [him] to his hand, I have even set a place for you to where he flees.
S’Il n’y a pas eu guet-apens et que Dieu seul ait conduit sa main, il se réfugiera dans un des endroits que je te désignerai.
14 And when a man presumes against his neighbor to slay him with subtlety, you take him from My altar to die.
"Mais si quelqu’un, agissant avec préméditation contre son prochain, le tue de guet-apens, du pied même de mon autel tu le conduiras à la mort.
15 And he who strikes his father or his mother is certainly put to death.
"Celui qui frappera son père ou sa mère sera mis à mort.
16 And he who steals a man, and has sold him, and he has been found in his hand, is certainly put to death.
"Celui qui aura enlevé un homme et l’aura vendu, si on l’a pris sur le fait, sera mis à mort.
17 And he who is reviling his father or his mother is certainly put to death.
"Celui qui maudit son père ou sa mère sera puni de mort.
18 And when men contend, and a man has struck his neighbor with a stone, or with the fist, and he does not die, but has fallen on the bed;
"Si des hommes se prennent de querelle et que l’un frappe l’autre d’un coup de pierre ou de poing, sans qu’il en meure, mais qu’il soit forcé de s’aliter,
19 if he rises, and has gone up and down outside on his staff, then the striker has been acquitted; he only gives [for] his cessation, and he is thoroughly healed.
s’il se relève et qu’il puisse sortir appuyé sur son bâton, l’auteur de la blessure sera absous. Toutefois, il paiera le chômage et les frais de la guérison.
20 And when a man strikes his manservant or his handmaid with a rod, and he has died under his hand—he is certainly avenged;
"Si un homme frappe du bâton son esclave mâle ou femelle et que l’esclave meure sous sa main, il doit être vengé.
21 only if he remains a day, or two days, he is not avenged, for he [is] his money.
Si pourtant il survit un jour ou deux, il ne sera pas vengé, parce qu’il est sa propriété.
22 And when men strive, and have struck a pregnant woman, and her children have come out, and there is no harm [to them], he is certainly fined as the husband of the woman lays on him, and he has given through the judges;
"Si, des hommes ayant une rixe, l’un d’eux heurte une femme enceinte et la fait avorter sans autre malheur, il sera condamné à l’amende que lui fera infliger l’époux de cette femme et il la paiera à dire d’experts.
23 and if there is harm [to them], then you have given life for life,
Mais si un malheur s’ensuit, tu feras payer corps pour corps;
24 eye for eye, tooth for tooth, hand for hand, foot for foot,
oeil pour oeil, dent pour dent, main pour main, pied pour pied;
25 burning for burning, wound for wound, stripe for stripe.
brûlure pour brûlure, plaie pour plaie, contusion pour contusion.
26 And when a man strikes the eye of his manservant, or the eye of his handmaid, and has destroyed it, he sends him away as a freeman for his eye;
"Si un homme blesse l’œil de son esclave ou de sa servante de manière à lui en ôter l’usage, il le renverra libre à cause de son œil
27 and if he knocks out a tooth of his manservant or a tooth of his handmaid, he sends him away as a freeman for his tooth.
et s’il fait tomber une dent à son esclave ou à sa servante, il lui rendra la liberté à cause de sa dent.
28 And when an ox gores man or woman, and they have died, the ox is certainly stoned, and his flesh is not eaten, and the owner of the ox [is] acquitted;
"Si un boeuf heurte un homme ou une femme et qu’ils en meurent, ce boeuf doit être lapidé et il ne sera point permis d’en manger la chair; mais le propriétaire du boeuf sera absous.
29 and if the ox is [one] accustomed to gore before, and it has been testified to its owner, and he does not watch it, and it has put to death a man or woman, the ox is stoned, and its owner is also put to death.
Si ce boeuf était sujet à heurter, déjà antérieurement, que son maître, averti, ne l’ait pas surveillé et qu’il ait fait périr un homme ou une femme, le boeuf sera lapidé et même son maître mérite la mort.
30 If atonement is laid on him, then he has given the ransom of his life, according to all that is laid on him;
Si toutefois une amende lui est imposée, il paiera la rançon de sa vie selon ce qu’on lui aura imposé.
31 whether it gores a son or gores a daughter, according to this judgment it is done to him.
Si un bœuf heurte soit un garçon, soit une fille, la même loi lui sera appliquée.
32 If the ox gores a manservant or a handmaid, he gives thirty silver shekels to their lord, and the ox is stoned.
Si ce bœuf heurte un esclave ou une esclave, on paiera à leur maître une somme de trente sicles et le boeuf sera lapidé.
33 And when a man opens a pit, or when a man digs a pit, and does not cover it, and an ox or donkey has fallen [in] there—
"Si quelqu’un découvre une citerne, ou si, en ayant creusé une, il ne la couvre point et qu’un boeuf ou un âne y tombe,
34 the owner of the pit repays, he gives back money to its owner, and the dead is his.
le propriétaire de la citerne doit payer: il remboursera la valeur au maître et l’animal mort lui restera.
35 And when a man’s ox strikes the ox of his neighbor and it has died, then they have sold the living ox, and halved its money, and they also halve the dead one;
"Si le bœuf appartenant à un homme blesse celui d’un autre et le fait périr, on vendra le bœuf vivant; ils s’en partageront le prix, et partageront aussi le bœuf mort.
36 or, [if] it has been known that the ox is [one] accustomed to gore before, and its owner does not watch it, he certainly repays ox for ox, and the dead is his.
Mais si, notoirement, ce boeuf a déjà heurté à plusieurs reprises et que son maître ne l’ait pas surveillé, il devra restituer boeuf pour boeuf et le boeuf tué lui restera.
