< Exodus 21 >
1 Now these are the judgments which you shall set before them.
是は汝が民の前に立べき律例なり
2 If you buy an Hebrew servant, six years he shall serve: and in the seventh he shall go out free for nothing.
汝ヘブルの僕を買ふ時は六年の間之に職業を爲しめ第七年には贖を索ずしてこれを釋つべし
3 If he came in by himself, he shall go out by himself: if he were married, then his wife shall go out with him.
彼もし獨身にて來らば獨身にて去べし若妻あらばその妻これとともに去べし
4 If his master have given him a wife, and she have born him sons or daughters; the wife and her children shall be her master's, and he shall go out by himself.
もしその主人これに妻をあたへて男子又は女子これに生れたらば妻とその子等は主人に屬すべし彼は獨身にて去べし
5 And if the servant shall plainly say, I love my master, my wife, and my children; I will not go out free:
僕もし我わが主人と我が妻子を愛す我釋たるるを好まずと明白に言ば
6 Then his master shall bring him unto the judges; he shall also bring him to the door, or unto the door post; and his master shall bore his ear through with an aul; and he shall serve him for ever.
その主人これを士師の所に携ゆき又戸あるひは戸柱の所につれゆくべし而して主人錐をもてかれの耳を刺とほすべし彼は何時までもこれに事ふべきなり
7 And if a man sell his daughter to be a maidservant, she shall not go out as the male servants do.
人若その娘を賣て婢となす時は僕のごとくに去べからす
8 If she please not her master, who has betrothed her to himself, then shall he let her be redeemed: to sell her unto a strange nation he shall have no power, seeing he has dealt deceitfully with her.
彼もしその約せし主人の心に適ざる時はその主人これを贖はしむることを得べし然ど之に眞實ならずして亦これを異邦人に賣ことをなすを得べからず
9 And if he have betrothed her unto his son, he shall deal with her after the manner of daughters.
又もし之を己の子に與へんと約しなばこれを女子のごとくに待ふべし
10 If he take him another wife; her food, her raiment, and her duty of marriage, shall he not diminish.
父もしその子のために別に娶ることあるとも彼に食物と衣服を與ふる事とその交接の道とはこれを間斷しむべからず
11 And if he do not these three unto her, then shall she go out free without money.
其人かれに此三を行はずば彼は金をつくのはずして出さることを得べし
12 He that strikes a man, so that he die, shall be surely put to death.
人を撃て死しめたる妻は必ず殺さるべし
13 And if a man lie not in wait, but God deliver him into his hand; then I will appoint you a place where he shall flee.
若人みづから畫策ことなきに神人をその手にかからしめたまふことある時は我汝のために一箇の處を設くればその人其處に逃るべし
14 But if a man come presumptuously upon his neighbour, to slay him with guile; you shall take him from mine altar, that he may die.
人もし故にその隣人を謀りて殺す時は汝これをわが壇よりも執へゆきて殺すべし
15 And he that strikes his father, or his mother, shall be surely put to death.
その父あるひは母を撃ものは必ず殺さるべし
16 And he that steals a man, and sells him, or if he be found in his hand, he shall surely be put to death.
人を拐帶したる者は之を賣たるも尚その手にあるも必ず殺さるべし
17 And he that curses his father, or his mother, shall surely be put to death.
その父あるひは母を罵る者は殺さるべし
18 And if men strive together, and one strike another with a stone, or with his fist, and he die not, but keeps his bed:
人相爭ふ時に一人石または拳をもてその對手を撃ちしに死にいたらずして床につくことあらんに
19 If he rise again, and walk abroad upon his staff, then shall he that stroke him be quit: only he shall pay for the loss of his time, and shall cause him to be thoroughly healed.
若起あがりて杖によりて歩むにいたらば之を撃たる者は赦さるべし但しその業を休める賠償をなして之を全く愈しむべきなり
20 And if a man strike his servant, or his maid, with a rod, and he die under his hand; he shall be surely punished.
人もし杖をもてその僕あるひは婢を撃んにその手の下に死ば必ず罰せらるべし
21 Notwithstanding, if he continue a day or two, he shall not be punished: for he is his money.
然ど彼もし一日二日生のびなば其人は罰せられざるべし彼はその人の金子なればなり
22 If men strive, and hurt a woman with child, so that her fruit depart from her, and yet no mischief follow: he shall be surely punished, according as the woman's husband will lay upon him; and he shall pay as the judges determine.
人もし相爭ひて妊める婦を撃ちその子を堕させんに別に害なき時は必ずその婦人の夫の要むる所にしたがひて刑られ法官の定むる所を爲べし
23 And if any mischief follow, then you shall give life for life,
若害ある時は生命にて生命を償ひ
24 Eye for eye, tooth for tooth, hand for hand, foot for foot,
目にて目を償ひ歯にて歯を償ひ手にて手を償ひ足にて足を償ひ
25 Burning for burning, wound for wound, stripe for stripe.
烙にて烙を償ひ傷にて傷を償ひ打傷にて打傷を償ふべし
26 And if a man strike the eye of his servant, or the eye of his maid, that it perish; he shall let him go free for his eye's sake.
人もしその僕の一の目あるひは婢の一の目を撃てこれを喪さばその目のために之を釋つべし
27 And if he strike out his manservant's tooth, or his maidservant's tooth; he shall let him go free for his tooth's sake.
又もしその僕の一箇の歯か婢の一箇の歯を打落ばその歯のために之を釋つべし
28 If an ox gore a man or a woman, that they die: then the ox shall be surely stoned, and his flesh shall not be eaten; but the owner of the ox shall be quit.
牛もし男あるひは女を衝て死しめなばその牛をば必ず石にて撃殺すべしその肉は食べからず但しその牛の主は罪なし
29 But if the ox were known to push with his horn in time past, and it has been testified to his owner, and he has not kept him in, but that he has killed a man or a woman; the ox shall be stoned, and his owner also shall be put to death.
然ど牛もし素より衝くことをなす者にしてその主これがために忠告をうけし事あるに之を守りおかずして遂に男あるひは女を殺すに至らしめなばその牛は石にて撃れその主もまた殺さるべし
30 If there be laid on him a sum of money, then he shall give for the ransom of his life whatsoever is laid upon him.
若彼贖罪金を命ぜられなば凡てその命ぜられし者を生命の償に出すべし
31 Whether he have gored a son, or have gored a daughter, according to this judgment shall it be done unto him.
男子を衝も女子を衝もこの例にしたがひてなすべし
32 If the ox shall push a manservant or a maidservant; he shall give unto their master thirty shekels of silver, and the ox shall be stoned.
牛もし僕あるひは婢を衝ばその主人に銀三十シケルを與ふべし又その牛は石にて撃ころすべし
33 And if a man shall open a pit, or if a man shall dig a pit, and not cover it, and an ox or an ass fall therein;
人もし坑を啓くか又は人もし穴を掘ことをなしこれを覆はずして牛あるひは驢馬これに陷ば
34 The owner of the pit shall make it good, and give money unto the owner of them; and the dead beast shall be his.
穴の主これを償ひ金をその所有主に與ふべし但しその死たる畜は己の有となるべし
35 And if one man's ox hurt another's, that he die; then they shall sell the live ox, and divide the money of it; and the dead ox also they shall divide.
此人の牛もし彼人のを衝殺さば二人その生る牛を賣てその價を分つべし又その死たるものをも分つべし
36 Or if it be known that the ox has used to push in time past, and his owner has not kept him in; he shall surely pay ox for ox; and the dead shall be his own.
然どその牛素より衝ことをなす者なること知をるにその主これを守りおかざりしならばその人かならず牛をもて牛を償ふべし但しその死たる者は己の有となるべし
